Rip Curl Update to Win (“Promotion”) CONDITIONS OF ENTRY

1. Information on how to enter and prizes form part of these conditions of entry. Entry into this promotion is deemed only in acceptance of these Conditions of Entry by each entrant. Any entry not complying with these terms and conditions is invalid.
2. Entry is open to Australian and New Zealand residents (“Eligible Entrants”). Directors and employees of the Promoter and its associated agencies and their immediate family members are not eligible to enter.
3. The Promotion commences on 10 October 2018 at 7.00pm (AEST) and closes on 17th October 2018 at 11.59am (AEST) (“Promotion Period”).
4. To enter, Eligible Entrants will be required to update their email preferences during the Promotion Period.
5. The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider.
6. Multiple entries will not be accepted.
7. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted or addressed, illegible or misdirected entries, claims or correspondence, whether due to error, omission, alteration, theft, destruction, communications or mail delivery failure or otherwise.
8. The Promoter reserves the right to request the winner to provide proof of Identity and proof of residency at the nominated prize delivery address in order to claim the Prize. Proof of identification and residency is at the discretion of the Promoter. In the event that the winner cannot provide suitable identification, the winner will forfeit the Prize in whole and no substitute will be offered.
9. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill to entrants and households using multiple email addresses, postal purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
10. Judging will take place on 17th October 2018 at Rip Curl 101 Surfcoast Highway, Torquay Victoria 3228.
11. This is a game of chance. 
12. The winner will be notified by email within 7 days of the judging date and will have their details published on the Rip Curl website.
13. The winner selected at random will win 1 "Rip Curl Summer Pack". The one winner will receive;
    • Springsuit Wetsuit
    • Pair of thongs
    • Hat
    • Towel
    • Valued at AU$500 RRP.
14. Total maximum Prize pool value is AU$500 RRP.
15. The Major Prize will be dispatched within 28 days of entrants being deemed as a ‘winner’.
16. The Major Prize value is based upon the recommended retail price at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in Prize value between now and the Prize redemption date.
17. The Major Prize is not transferable or exchangeable and cannot be taken as cash.
18. If any winners are under the age of 16yrs the prize will be awarded to a parent or guardian.
19. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of participating in the promotion or the taking of a Prize, except for any liability which cannot be excluded by law.
20. The Promoter reserves the right to cancel, terminate, modify or suspend the Promotion subject to any written directions from the various lottery departments.
21. The Promoter will hold the personal information provided by entrants in entering this Promotion so they can be contacted if they are the Prize winner. Entrant’s personal information may also be disclosed to the Promoter's employees, related companies and agents for the provision of marketing services and information on the products or services offered by the Promoter. If an entrant provides their email address and mobile phone number, they are agreeing to be a receipt of marketing communication through these channels. Entrants' personal information may be disclosed to State lottery departments and winners' names published as required under the relevant lottery legislation. Entrants have a right to access personal information the Promoter holds about them. 22. The winner agrees to the Promoter using their name, image, and any photographs or footage (“materials”) of the winner accepting or using the Prize for publicity or promotional purposes, without compensation, and agrees that the Promoter will own all copyright and other intellectual property rights in any such materials.
23. Taxation implications may arise from the winning of the Prize and the winner should seek independent financial advice prior to accepting the Prize. The Promoter is in no way responsible for any tax implications arising as a result of the winner accepting the Prize.
